General Conditions of Sale
1. Scope of application
These "general terms and conditions of distance selling" apply to sales contracts concluded at a distance between Dépôt-Design SRL, whose registered office is located at Avenue du Port 86C in 1000 Brussels, and its customers. In addition to these "general terms and conditions of distance selling" which are specific to sales concluded exclusively via the internet and/or at a distance, there are "general terms and conditions of in-store sales". The general terms and conditions of online sales apply when the parties have used exclusively one or more remote communication techniques for the contract until the conclusion of the contract, including the conclusion of the contract itself. In other cases, the general terms and conditions of in-store sales apply. Orders by the customer via the website are only possible if the customer accepts by clicking these "general terms and conditions of online sales", which prevail over all other conditions.
2. Webshop Catalog
Although Dépôt-Design takes great care in developing and updating the webshop, the catalogue inevitably presents differences compared to the actual items, particularly with regard to colours. A mention in the catalogue does not necessarily mean that the item is available. Dépôt-Design declines all liability in the event of inaccuracy, error or omission in the catalogue, except in the event of gross negligence or fraud.
3. Price
The prices listed on the Webshop are:
- VAT included
- Assembly and installation of furniture not included
- Delivery to the Avenue du Port store or to the Laeken depot (and therefore transport costs not included)
All taxes, duties and charges of any nature, due as a result of the sale in addition to the price including VAT, are the responsibility of the customer.
Note : The price displayed is always indicative, reflecting the lowest price for different combinations of model, dimensions, material, finish and color. Final prices, which may vary depending on customization, are available in the supplier's official price list, available upon request via our contact form .
4. Payment methods
For purchases via the Webshop, the customer chooses between the following 4 payment methods:
- Direct payment with bank card or credit card
- A bank transfer via Paypal
- A bank transfer via the bank. The customer who chooses this option will receive, after confirming his order, an e-mail with payment instructions.
- Payment of a deposit in Cash or by Bancontact/Visa/MasterCard at the store located at Avenue du Port 86C in 1000 Brussels.
5. Deposit
When the customer chooses to pay a deposit, this is at least 50% of the price including VAT. In the case of goods made to measure or according to the customer's specific wishes, the customer pays a deposit of 100% of the price including VAT. If the customer fails to execute the contract within 12 months, the deposit will be retained by Dépôt-Design.
6. Payment
Invoices or debit notes are payable at the Dépôt-Design store, Avenue du Port 86C in 1000 Brussels. Goods are payable at the time of ordering via the internet or in cash. In the event of an order, the balance not covered by the deposit is paid at the latest when the goods are collected from the Dépôt-Design store or depot by the customer or by the carrier chosen by the customer. In the event of home delivery by Dépôt-Design, the balance of the price is paid before delivery. Any amount unpaid on the due date will be automatically and without formal notice increased by interest at the rate of 9% per year and by compensation of 15% of the amounts due, with a minimum of €200, to be increased by recovery costs and fees.
7. Proof
By express agreement between Dépôt-Design and the customer, e-mails are authentic between the parties as well as the automatic recording systems used on the Webshop, in particular as regards the nature and date of the order. The customer can access the electronic contract that he has concluded by sending an e-mail to the address office@depotdesign.be
8. Delivery times
Unless otherwise stated on the webshop or on the order summary, the delivery period is 8 weeks starting the day after the customer has submitted his order and received the order summary. The contractual delivery period may be extended by 25% by the seller. It is extended by the duration of the annual closure of suppliers or the duration of impossibility of execution in the event of force majeure.
9. Delivery
When ordering via the webshop, the customer has the choice between two delivery options.
- Collection by the customer at Dépôt-Design, which is free. The collection of small and medium-sized items (small furniture, lighting items, home accessories, etc.) is done at the store located at Avenue du Port 86C in 1000 Brussels, while larger furniture is to be collected at the Dépôt-Design depot located at rue Tielemans, 2 in 1020 - Laeken.
After receiving the ordered goods, Dépôt-Design will send the customer by email or by post a notice of arrival informing them that the goods are available for collection. Dépôt-Design's obligation to deliver the item is fulfilled by sending this notice of arrival. The customer is obliged to collect the goods within 30 days from receipt of the notice of arrival. In the event of delay or absence of collection, Articles 18 and 19 will apply.
- Delivery by Dépôt-Design or its usual transport partners.
For orders up to €100, the delivery costs in the Benelux and France are flat-rate as indicated on the webshop. For furniture deliveries in the Benelux and France above this amount, the delivery costs vary depending on the weight and volume of the order. They are indicated in the shopping cart. These prices are for delivery to the ground floor or up to the 2nd floor (without elevator) and without assembly of the furniture.
It is the customer's responsibility to check that the items ordered can be delivered by access route to the place of delivery. In the event of obstacles to delivery, the customer may request a specific quote from Dépôt-Design or the carrier for this.
Deliveries of furniture orders via the Internet are carried out by partners specializing in furniture delivery. Delivery times are on average longer than those announced by stores that work exclusively via the Internet. The delivery time shown on the order summary is therefore given as an indication.
The partners of Dépôt-Design, DPD, Ziegler, France Express, Shippr, BPost, will contact the customer to arrange a delivery day and time.
The carrier's inability to deliver on the agreed date due to the absence of the customer or due to obstacles not mentioned by the customer, may give rise to the payment by the customer of additional delivery costs.
10. Delivery of multiple items
Items ordered in the same basket will in principle be delivered in a single delivery, on the date of availability of all the products ordered. In the event of a split delivery, the costs will also be split.
11. Assembly
Assembly and assembly of furniture is not included in the delivery or delivery costs.
12. Retention of title
The transfer of ownership only takes place after full payment of the sale price and its costs and accessories.
13. Transfer of risks
The risks of deterioration or loss of the goods due to unforeseeable circumstances are transferred to the customer from the moment the goods are collected by the customer or by the carrier chosen by the customer. When the order summary specifies that the goods are delivered by Dépôt-Design, these risks are transferred to the customer upon delivery.
14. Final sale
The order is firm for the customer from the moment it is confirmed. For Dépôt-Design, the order is firm from the validation of the payment and the confirmation of the receipt of the order.
15. Right of withdrawal
The customer, if he is a private consumer, has the right to withdraw from this contract without giving any reason within 14 days from the date of delivery or physical possession of the goods. The customer does not have a right of withdrawal from the contract for goods made to his specifications. This includes all furniture items that are "made to order", requiring customization, and which cannot be returned to the manufacturer. To exercise the right of withdrawal, the customer must notify his decision to withdraw from the contract by sending by registered mail addressed to Dépôt-Design, Avenue du Port 86C, 1000 Brussels, either the withdrawal form available on the website, dated and signed, or a letter declaring his decision to withdraw.
In the event of exercising the right of withdrawal, the customer must return the goods in full, in good condition and in their original packaging within one month of sending their decision to withdraw. The return costs (an amount equal to the delivery costs) will be borne by the customer. Dépôt-Design will instruct a partner carrier to collect and transport the goods and will reimburse the customer, less the return costs, within 30 days of the return of the goods. The reimbursement will be made using the same payment method as that used by the customer.
16. Complaints - Guarantees
The customer undertakes to examine the delivered goods as soon as possible in order to check that they do not have any apparent defects or that they have not been damaged during transport. In the event that a problem or apparent defect appears during unpacking or assembly in the customer's residence, the latter must inform Dépôt-Design as soon as possible by email to office@depotdesign.be or by post to Dépôt-Design – Avenue du Port 86C in 1000 Brussels and must provide all the elements (description, photo, etc.) attesting to the problem or apparent defect. The goods will be considered accepted by the customer and approved if the latter has not sent an email or letter of complaint within 7 calendar days from the date of delivery. After this period, and except in special circumstances on which the customer can legitimately rely, any claim based on an apparent defect cannot be accepted. This clause does not affect the legal guarantee for lack of conformity and for hidden defects. In the event of a lack of conformity or hidden defect appearing, the customer must inform Dépôt-Design – Avenue du Port 86C in 1000 Brussels in writing within two months of discovering the lack of conformity or hidden defect. Dépôt-Design provides the legal guarantees provided for by the binding provisions of Belgian law on the goods sold, provided that the customer has fulfilled all of his contractual obligations. As a general rule, the guarantee is two years from the date of delivery. The customer must produce the receipt, delivery note or invoice.
17. Delay in delivery
In the event that the seller exceeds the contractual delivery time by more than 25% and except in cases of force majeure on the part of Dépôt-Design, the customer has the right, in accordance with the law, to terminate the contract by sending a registered letter addressed to Dépôt-Design at its registered office at Avenue du Port 86C, 1000 Brussels, provided that at that time, Dépôt-Design has not yet delivered or made the goods available to the customer. The deposit or price paid by the customer will be refunded to him within 30 days to the bank account he has provided.
18. Delay in removal
In the event that the customer fails to fulfil his obligation to take delivery of the goods at the store or warehouse within the contractual period of 30 days when he has been invited to come and collect the goods, the customer will be automatically liable for an occupation fee of an amount equal to 10 euros per m3/week from the expiry of the final period of 15 days given for collection.
19. No Removal
In the event that the customer, after having been formally notified by registered letter to collect the goods within a final period of 15 days, still does not fulfil his obligation to collect the goods, Dépôt-Design will be entitled to:
- or to pursue the execution of the sale in court
- or to terminate the sale due to the customer's fault by sending a registered letter noting the customer's breach and the termination of the sale. In the event of termination based on the customer's failure to fulfill his obligation to collect the goods, compensation in an amount equal to 50% of the amount of the goods will be due by the customer. The compensation will be in an amount equal to 75% of the amount of the goods if the goods are made to measure or according to the customer's personal wishes.
20. Force majeure
Each party may invoke force majeure to temporarily or permanently suspend the performance of its obligations. War, mobilization, strikes, lockouts, machine breakdowns, fires, explosions, energy supply problems, interruption of means of transport and any exceptional event preventing or hindering the manufacture, shipment or sale of the goods are conventionally considered as cases of force majeure, whether they occur at the seller, its subcontractors or supplier.
21. Liability
Dépôt-Design is only liable in the event of fraud or serious misconduct on its part or that of its staff. Even if Dépôt-Design is required to pay compensation, this will always be limited to the direct and personal damage suffered by the customer. Indirect damages are not compensated.
22. Respect for privacy
In accordance with the provisions of the GDPR legislation and the law of 8 December 1992 on the protection of privacy concerning the processing of personal data, the customer explicitly authorises Dépôt-Design to record in a file all the personal data that Dépôt-Design has obtained on the customer and to process them. The personal data provided under these conditions are exclusively intended for internal, commercial and marketing use. If the customer wishes to object, they will simply need to send a letter by post to Dépôt-Design's customer service department, clearly stating their full name and address. The customer can access the file containing their personal data at any time in order to know its content or to make any corrections. To do this, they simply need to send a letter by post to Dépôt-Design, stating their name and address. We never sell or rent personal and individual information about you.
23. Safeguard clause
In the event that one of the stipulations of these general conditions is considered null or not applicable, the other clauses will remain applicable.
24. Change of address
The customer will inform Dépôt-Design of their change of address.
25. Applicable law – Competent court
Belgian law applies to this contract. In the event of a dispute, the French-speaking courts of Brussels will have jurisdiction.
General conditions of sale in store

In addition to these “general terms and conditions of in-store sales”, there are “general terms and conditions of online sales” specific to sales concluded exclusively online or at a distance. The general terms and conditions of online sales apply when the parties have used one or more remote communication techniques for the contract exclusively up until the conclusion of the contract, including the conclusion of the contract itself. In other cases, the general terms and conditions of in-store sales apply. The order confirmation or the signature of the purchase contract by the customer implies unconditional acceptance of these general terms and conditions of sale, which prevail over all other conditions.
2. Brochures
Brochures, catalogues, price lists, notices and, in general, documentation, are carefully written and updated. They are for information purposes only and cannot constitute a contractual offer.
3. Price
Unless otherwise agreed in writing between the parties, the prices are understood to be:
- VAT included
- Assembly and installation of furniture not included
- Delivery to the Avenue du Port store or to the Laeken depot (and therefore transport costs not included)
- All taxes, duties and charges of any nature, due as a result of the sale in addition to the price including VAT, are the responsibility of the customer.

After receiving the ordered goods, Dépôt-Design will send the customer a delivery notice by email or post informing them that the goods are available for collection. Dépôt-Design's obligation to deliver the item is fulfilled by sending the delivery notice. The customer is obliged to collect the goods within 30 days of receipt of the delivery notice. Unless otherwise stated in writing on the order form, the customer will organize the collection of the goods and/or their shipment from the Dépôt-Design store or warehouse themselves, at their own expense. The customer chooses their carrier. They are free to choose a partner carrier that is independent of Dépôt-Design. Even when the order form stipulates that the goods are delivered by Dépôt-Design, delivery is understood to be excluding assembly.
9. Retention of title
The transfer of ownership only takes place after full payment of the sale price and its costs and accessories.
10. Transfer of risks

When the purchase order stipulates that the goods are delivered by Dépôt-Design, these risks are transferred to the customer upon delivery.
11. Final Sale – Return of Goods
The sale is complete and final when there is an acceptance by the purchaser of an offer from the seller determining the thing sold and its price. Once the sale is complete and final, the parties cannot terminate or cancel it except in the event of a breach by one party as indicated below. Returns of goods and exchanges are not accepted except for low-value gift items. These may be exchanged (but not refunded) within 14 days of purchase provided that they are returned in their original packaging, that they have not been used or damaged and that the receipt is produced. Returns of goods and exchanges are never accepted when they are items sold during the sales period or with a very significant price reduction on the catalog prices due to the fact that they were displayed in the showroom or in the outlet department.

In the event of the appearance of a lack of conformity or hidden defect, the customer must inform Dépôt-Design – Avenue du Port 86C in 1000 Brussels - in writing within two months of the discovery of the lack of conformity or hidden defect. Dépôt-Design gives on the goods sold the legal guarantees provided for by the binding provisions of Belgian law to the extent that the customer has fulfilled all his contractual obligations. As a general rule, the guarantee is two years from the date of delivery. The customer must produce the receipt, delivery note or invoice.
13. Delay in delivery
In the event that the seller exceeds the contractual delivery time by more than 25%, the customer must first notify Dépôt-Design in writing, giving it a final deadline of 15 days to make the delivery. If delivery does not occur within the deadline indicated by the customer, the latter will have the option of cancelling the sale by sending, within 30 days following the expiry of the final deadline, a registered letter addressed to Dépôt-Design. In this case, the deposit paid by the customer will be refunded within 30 days to the bank account provided by the customer. The customer will not be entitled to any compensation or other indemnity.
14. Delay in removal
In the event that the customer fails to fulfil his obligation to take delivery of the goods at the store or warehouse within the initial contractual period of 30 days when he has been invited to collect the goods, the customer will be automatically liable for an occupation fee of an amount equal to 10 euros per m3 per week from the expiry of the contractual period of 30 days provided for taking delivery.
15. No Removal
In the event that the customer, after having been formally notified by registered letter to collect the goods within a final period of 30 days, still does not fulfill his obligation to collect the goods, Dépôt-Design will be entitled: either to pursue the execution of the sale in court or to terminate the sale at the customer's fault by sending a registered letter noting the customer's breach and the termination of the sale. In the event of termination based on the customer's failure to fulfill his obligation to collect the goods, compensation equal to the amount of the deposit, and at least 50% of the price of the goods, will be due by the customer. The compensation will be equal to the amount of the deposit, and at least 75% of the price of the goods, if the goods are made to measure or according to the customer's personal wishes.
16. Force majeure

18. Wedding list
Customers who submit a wedding list agree to come and select and collect the goods within two years of the event. At the end of this period, the list and the account will be closed.
19. Validity of vouchers
“Gift vouchers” and “vouchers” are valid for one year.
